Cancellation Policy
This Cancellation Policy explains how customers may cancel services provided by Novaxelon.
Novaxelon provides digital marketing, AI automation, website and application development, consultancy, software solutions, advertising and other technology-related services.
1. Cancelling a Service
Cancellation requests should be submitted through the contact details published on the Novaxelon website or through the communication method specified in the applicable service agreement.
A cancellation request should include:
- Customer or company name
- Invoice or order number
- Service or project name
- Requested cancellation date
- Reason for cancellation, where applicable
2. One-Off Projects
For one-off projects, cancellation rights and financial consequences may depend on the stage of the project.
If cancellation occurs before work begins, Novaxelon will assess whether any amount is refundable under the applicable agreement.
If work has already started, Novaxelon may charge or retain amounts relating to work already completed and reasonable non-recoverable costs, subject to applicable law.
Examples may include:
- Discovery and strategy work
- Research
- Design work
- Development work
- Content creation
- Configuration
- Project management
- Third-party software or services
- Advertising expenditure
3. Recurring Services
For recurring services, customers may request cancellation of future service periods.
Where a notice period or minimum contractual term applies, this will be clearly stated in the applicable agreement, proposal or order confirmation.
Cancellation will generally take effect at the end of the applicable notice period unless otherwise agreed.
4. Cancellation After Work Has Started
If a customer requests cancellation after Novaxelon has started providing a service, Novaxelon may be entitled to payment for services already supplied and reasonable costs already incurred, subject to the applicable contract and law.
Where applicable, Novaxelon will provide a reasonable breakdown of amounts due.
5. Advertising Campaigns
If Novaxelon is managing advertising campaigns, cancellation of the Novaxelon service does not necessarily cancel advertising expenditure already committed to advertising platforms.
Where advertising expenditure has already been incurred or committed, the customer may remain responsible for those amounts where permitted by the applicable agreement and law.
6. Third-Party Services
Cancellation of a Novaxelon service may not automatically cancel third-party services purchased or configured on behalf of the customer.
Examples include:
- Hosting
- Domains
- Software subscriptions
- API services
- Advertising platforms
- Email platforms
- AI services
- Other third-party technology
Customers may be responsible for third-party charges that cannot be cancelled or refunded.
7. Statutory Cancellation Rights
Where a customer has a statutory right to cancel a contract, Novaxelon will respect that right.
For contracts concluded at a distance with consumers, specific cancellation rights may apply depending on the nature of the service.
Where a customer asks Novaxelon to begin supplying a service during a statutory cancellation period, additional rules may apply regarding payment for services already supplied.
Where a service is fully performed within a statutory cancellation period following the customer’s express request and legally required acknowledgement, the statutory cancellation right may cease where the applicable legal conditions are satisfied.
8. Cancellation of Bespoke Digital Services
Certain Novaxelon services are highly customised and may involve work beginning shortly after an order is accepted.
Customers should therefore carefully review the applicable proposal, Statement of Work and cancellation terms before authorising work to begin.
Any legally required cancellation rights remain unaffected.
9. Cancellation by Novaxelon
Novaxelon may suspend or terminate services where permitted by the applicable agreement, including circumstances such as:
- Non-payment
- Material breach of contractual terms
- Misuse of our services
- Fraudulent activity
- Unlawful activity
- Failure to provide information reasonably required to deliver the service
- Circumstances outside our reasonable control
Where appropriate, Novaxelon will provide notice and an opportunity to remedy a breach before termination.
10. Effect of Cancellation
Following cancellation:
- Access to services may cease in accordance with the agreement.
- Outstanding amounts for services already supplied may remain payable.
- Third-party charges may remain payable where applicable.
- Project files or deliverables will be handled according to the applicable agreement.
- Any refund will be assessed under the Refund & Dispute Policy and applicable law.
11. Statutory Rights
Nothing in this Cancellation Policy is intended to exclude or restrict any statutory rights that cannot legally be excluded or restricted.
12. Contact
Cancellation requests should be submitted using the contact information published on the Novaxelon website.
